General Commercial Terms and Conditions (GCTC)

1. Definitions

1.1 Agreement between ecomVia a.s. as Operator and user. The acceptance of these GCTC is liable. Mentioned conditions are applied by using of internet web-site belgium-products.com, identified as uniform resource locator - belgium-products.com, in property of operator.

1.2 belgium-products.com is an online internet application, which is providing information about its registered user to its visitors, according to the conditions stated in these GCTC.

1.3 ecomVia Global System - ecomVia (hereinafter as "eGS") is self-interconnected system of internet web sites, sharing simmilar source code of online internet application and information about their registered users in property and operation of operator.

2. Terms of use

2.1 Operator reserves the right of changing GCTC without previous notification to user. Operator undertakes, that any change of GCTC won't significantly appear on previous agreements. The actual content of GCTC is placed on belgium-products.com for unlimited user's review possibility.

2.2 GTCT take effect by the day of issue, that is shown in the footer of GCTC. GCTC are marked by actual number of issue and operator archives all previously issued versions for possible usage of any part in future. By issuing a newer version of GCTC, all previously issued versions are loosing their effect and can't be demanded in any way. Above mentioned rules are applied even to price list of service subscriptions and other services provided by operator.

2.3 Operator does not take any responsibility for data provided by user by his/her registration and shown either in company profile and product descriptons.

2.4 Operator is continously evolving activities for preventing from unfair activities from user, that will cause spreading of incorrect information and by spreading which the international law and regulations might be broken.

2.5 In case, that operator identifies such activity of user, operator will perform technical measures for immediate removal of fault status. In addition, operator reserves the right to immediate delete of user from database, in case of identification of mentioned activity from user.

2.6 Operator performs steps for archiving and documentation of such activity of user for eventual needs of legal process or needs of Court.

2.7 By deleting of user from database for above mentioned reasons, user looses any demand on payed subscribed service for subscribed period. Operator will bill this unused period as a cancelling fee for deleting of user's data, because of braking statues stated in these Terms of Use.

2.8 Forbidden content of belgium-products.com's sites:

Each User hereby represents, warrants and agrees that information submitted to belgium-products.com for display on the Site shall not:

a. contain fraudulent information or make fraudulent offers of items or involve the sale or attempted sale of counterfeit or stolen items or items whose sales and/or marketing is prohibited by applicable law, or otherwise promote other illegal activities;

b. be part of a scheme to defraud other Users of the Site or for any other unlawful purpose;

c. relate to sale of products or services that infringe or otherwise abet or encourage the infringement or violation of any third party's copyright, patent, trademarks, trade secret or other proprietary right or rights of publicity or privacy, or any other Third Party Rights;

d. violate any applicable law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);

e. be defamatory, libelous, unlawfully threatening or unlawfully harassing;

f. be obscene or contain or infer any pornography or sex-related merchandising or any other content or otherwise promotes sexually explicit materials or is otherwise harmful to minors;

g. promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

h. contain any material that constitutes unauthorized advertising or harassment (including but not limited to spamming), invades anyone's privacy or encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any law or regulation;

i. solicit business from any Users in connection with a commercial activity that competes with belgium-products.com;

j. contain any computer viruses or other destructive devices and codes that have the effect of damaging, interfering with, intercepting or expropriating any software or hardware system, data or personal information;

k. link directly or indirectly to or include descriptions of goods or services that are prohibited under this Agreement; or

l. otherwise create any liability for eGSVia a.s. or its affiliates.

2.9 belgium-products.com reserves the right to delete any kind of content provided by user braking above stated rules without previous notification to user.
Information and relationships between supplier and buyer
2.10 Operator evolves activities to prevent from unfair activities and practises of user, offering his/her own products in way, that may cause any kind of misunderstanding of potential buyer and even in way, that may cause braking of international law and legal regulations.

2.11 However, operator does not take any responsibility for financial and any other losses caused to supplier, or buyer, based on information and contracts created by using of belgium-products.com.

3. Payment conditions

3.1 The usage of portals is FREE OF CHARGE to those visitors and Free Suppliers, who have agreed with these GCTC.

Extended services fees
3.2 Fees of extended services - Eminent supplier membership are billed as 1 year long subscription of such services. The subscription begins by the day of order.

3.3 14 days before the subscription period ends, the Billing department notifies user about this matter via e-mail. In addition Billing department informs user about the possibility and the circumstances at which the user can apply for extension of this subscription to another 1 year long period.

3.4 If user doesn't respond to this notification, or he doesn't extend his/her membership subscription, the user's account is automaticaly switched to Free Supplier membership and another notification e-mail will be sent to user.

3.5 Operator accepts orders of subscriptions via portal's ordering system ONLY.

3.6 The only way to pay for subscribed services is by supported credit cards, which logos are shown in portal's ordering system.

3.7 The subscription fees are calculated according to actual price list available to user.

3.8 The VAT charge in amount of 19% is based on registered tax location of belgium-products.com 's operator. The VAT exlusive prices are applicable to companies and sole-traders from member countries of the EU (with valid VAT No.) and persons with registered address outside EU.

3.9 The VAT inclusive prices are applicable to taxpayers and non-taxpayers from operator's registered tax location and private entities with registered address in one of the member countries of the EU (without VAT No.). 3.10 After the payment for subscribed services is successfully processed, user receives the payment receipt and invoice via e-mail. If user requests the printed invoice - he/she needs to request it by ordering the subscription of the services. The printed invoice, sent via regular mail will be billed according to the actual price list available to user.

3.11 Whole payment processed is protected by SSL encryption.

4. Refund policy

The consumer has the right to withdraw from the contract based on already payed order of service subscription.

The consumer contract and notice about the right of withdrawal from this contract

4.1 In case, that the realisation of performance subject is based on contract agreed via mediums of remote communication, the user of belgium-products.com (as the recipient of this performance subject, hereinafter as "consumer") has the right to withdraw from this contract.

4.2 The time period, during which the consumer has the right to withdraw from contract without given reason is 15 calendar days, since the contract has been agreed.

4.3 The consumer's withdrawal from contract must be done using medium of remote communication - exclusively using this online form, created for this purpose, where the consumer distinguishes his decision of withdrawal from order. Consumer will be notified via email from operator of belgium-products.com about successful receiving of his withdrawal request.

4.4 The notification about withdrawal from remotely agreed contract must be delivered to operator within the period, during which the consumer has the right of withdrawal from this contract.

4.5 After applicable withdrawal from contract, the consumer beGSs the right to have the payed amount for subscribed service refunded. The consumer bears all fees (bank fees etc.) associated with the refund of this amount. The payed amount will be refunded to the credit / debit card, using which the payment has been done.

4.6 The consumer and operator have negotiated following refund fees associated with withdrawal from contract:

The consumer undertakes to be charged of fees associated with payed amount refund and billed to operator from provider of payment system, using which the payment has been processed. The amount of mentioned fee associated with payed amount refund is calculated by adding the fee associated with receiving the payed amount for subscribed services and even by adding the fee associated with refund of payed amount.

4.7 "The consumer" means user, that is not acting for his/her own business activities or activities of other commercial activity.

5. Your feedback

5.1 User communicates with operator of portal using Contact us section. Usage of this section asures the successful and right delivery of his query to operator.

5.2 The system of portal assigns unique code to every single message, what assures the identification of this message in support system and notifies user about successful receiving of his/her message.

Portal's operators crew undertakes to solve all unsolved issues in the shortest time.

User is notified about the result of solved issue via e-mail sent to the e-mail address in the company profile.

By using other ways to contact, operator doesn't guarantee the successful delivery of user's issue.

6. User's access to data.

6.1 All data regarding to the company profile, user settings, informations about particular technical procedures (registration process, order of service subscription...) resulting into applicable contract agreement and even all data created during the term of contract, order of services subscription, invoices are archived by system. All of the mentioned data are available to user in his/her user account. Other data can be provided to user on demand.

6.2 User gets the access to his/her user account regarding to the applicable and full registration to the system of portal. Operator reGSmends to user to change default access data and prevent the misuse of his/her user account and personal information by unauthorized persons.

Control of Your Password

6.3 User is responsible for all actions taken with his/her Login and password, including those actions that result in fees being charged to user's account. Therefore operator does not reGSmend that user discloses his/her password to any third parties.

6.4 If user does choose to share his/her Login and password or his/her information with third parties to where it is necessary to do so for them to provide him/her additional services, user is responsible for all actions taken with with his/her Login and password and therefore user should review that third party's privacy policy.

6.5 If user loses control of his/her password, user may lose substantial control over his/her personally identifiable information and may be subject to legally binding actions taken on his/herbehalf. Therefore, if user's password or account has been compromised for any reason, user should immediately change his/her password.

7. Warranties

7.1 belgium-products.com gives no warranty with regard to the performance of contracts concluded between users and no warranty for defects in the goods or services offered. In particular, belgium-products.com assumes no obligation with respect to performance of contracts concluded between users.

7.2 The information concerning goods/services provided by users and published by the latter within the CISe does not constitute promises made by belgium-products.com concerning quality characteristics.

7.3 belgium-products.com cannot give any warranty as to the true identity and power of disposal of users. In case of doubt, both contractual partners are advised to make suitable inquiries as to the true identity and power of disposition of the other partner.

8. Final regulations

8.1 To all legal dispustes concerning from these GCTC, the legal venue and national law of operator's registered address shall apply.

8.2 These conditions take effect by user's agreement (checkbox checking) by filling data to the company profile.

8.3 The user registration on portal ends after operator process the unregistration request of user.

8.4 User has reviewed content of these GCTS by using mediums of remote communication on internet sites of belgium-products.com and obviously has agreed with them, by checking the "I agree..." checkbox.

8.5 The unregistration of user must be done using the medium of remote communication on internet site - by using the unregistration form ONLY. User will be notified about successful receiving of unregistration request via email.

8.6 The unregistration will be confirmed to user by a plain-text email message sent to email address provided by user in his/her company profile.
